The Means Test is a major part of the Bankruptcy Reform Act of 2005. Congress enacted it to devise an income test to determine eligibility to file a Chapter 7 bankruptcy. If you fail the test – you can file a Chapter 7 bankruptcy – otherwise you are forced into a Chapter 13.
The Means Test is a “look back” test which averages your income over the previous six (6) month period. The test compares your income to the “median household income” in your county.
If your income is below the “median household income,” you are eligible to file a Chapter 7 bankruptcy. If you “pass” the means test, you may still be eligible to file a Chapter 7 – BUT it gets too complicated for an easy FAQ answer.
